Dear Mr. Harrington,

Pursuant to the Kansas Open Records Act (K.S.A. 45-215 et seq.), I am submitting this formal request for public records related to the denial of my building permit(s) for the project near 37th & Gage.

Please provide the following records:

  1. All documents, emails, memoranda, notes, or correspondence that reference or explain the denial of the building permit, particularly any issues related to proposed ground treatment, crushed gravel, aggregate, geotextile fabric, or right-of-way improvements.
  2. All communications (internal and external) from or to the Public Works Director, Engineering Division, or other City staff regarding the statement that “crushed gravel is not approved for the right of way.”
  3. Any City policies, standards, specifications, or guidelines that prohibit or restrict the use of gravel, crushed stone, or aggregate mulch as ground treatment in the public right-of-way.
  4. Any inspection reports, plan review comments, or denial notices issued for this specific project concerning ROW ground cover or drainage/erosion control.
  5. Records of any similar approvals or denials of comparable ground treatments (geotextile + aggregate) on other Topeka development projects in the past 36 months.

Please produce these records in electronic format where possible.

Please provide the records as soon as possible and no later than the timeframe required by KORA. If any portion of this request is denied, please provide a written explanation citing the specific legal exemption.

I was told the crushed gravel is not approved for the right of way. That came from the Public Works Director.

A full landscape design plan with drawings from a landscape architect or civil engineer noting locations, species type, spacing from ROW infrastructure, back of curb and sight triangle distance from intersections will be required before any alternate proposal will be considered.

 

This applicant has used up all of their informal requests.  They were told to comply with standard ROW design or to submit a xeriscaping proposal for review.  If they have a design plan with full drawings they may submit that, otherwise they need to conform to existing ROW standards as specified in the existing design criteria.

Spacing Recommendations

For a linear 400-foot ROW:

  • Every 8–15 feet (center to center) for most 3–6 ft mature shrubs. This creates rhythm and visual breaks in the rock without overcrowding or blocking traffic/sight lines.
    • Closer spacing (6–10 ft) for a denser, more filled look over time (they'll spread modestly).
    • Wider (12–20 ft) for a sparser, modern/desert-inspired aesthetic with more rock visible.
  • Stagger in two informal rows (if width allows) for natural flow — e.g., offset plants on either side of the strip.
  • Total plants: Roughly 25–50 shrubs depending on exact spacing and strip width (e.g., 10–12 ft centers for ~30–40 plants). Start conservatively and let them fill in.

Key ROW Considerations:

  • Keep mature height/width low enough not to impede traffic, pedestrians, or visibility (generally under 3–4 ft in critical sight zones; check city standards for clear zones).
  • Plant slightly back from edges if possible.
  • Amend planting pockets with native soil/compost for better establishment, then surround with river rock.

We said we would consider a xeriscaping proposal which is what he asked for that would be environmentally friendly and reduce long term maintenance.  In order to be considered a xeriscaping proposal which is what he suggested, the aggregate would have to be decorative and be combined with a landscaping plan that included decorative elements like decorative grasses, plants, other ground cover or shrubs that would not impede traffic.

 

We will not accept a proposal that is simply placing aggregate in the ROW to avoid the cost of restoring the area to a proper condition.  If the applicants only concern is the lowest cost option, seed is recommended.

Is there a rock that was allowed on another site that you can just point us to?

 

Lot of back and forth on decorative rock that looks like rock. If its just "no" we need a little more insight as to why...
